Our trade mark application process is conducted in two phases –
Before we can file your trade mark application, it is vital that we undergo research of your brand and business to devise your comprehensive brand protection strategy. Without completing the required due diligence before filing a trade mark application, you leave yourself vulnerable to objections from the EUIPO and unexpected challenges to your trade mark application (e.g. a letter before action or an official opposition against your application).
In the Brand Protection Strategy, we analyse your brand and provide formal legal advice relating to your prospective trade mark application. This will include a list of classes relevant to your brand (with a snapshot of goods/services), a breakdown of your branding elements, registrability advice, high risk searching advice, and costs related to drafting the specification, alongside preparing and filing the application.
We provide the Brand Protection Strategy at a cost of £200+VAT for one trade mark application and £50+VAT for each additional application.
Our professional fees (including local associate fees) for an EU basic application start at £550+VAT for drafting and preparing one trade mark application in one class. We charge £50+VAT for each additional class thereafter. Further, there is a £50+VAT administration fee for filing the application and dealing with the basic formalities and non-contentious deadline management. You will also need to pay the EUIPO’s official filing fees which are €850 for the first class, €50 for the second class, and €150 for each additional class from the third class onwards.
The EUIPO’s filing fees are paid in Euros by our firm. In order to account for exchange rate fluctuations and bank charges, we add 12.5% to the official EUIPO fees.

This will allow you to see how unique your trade mark is. It will also give you an indication as to whether there are any high-risk obstacles that could stand in the way of your application.

According to European Trade Mark law, trade marks cannot be registered if they are non-distinctive, describe characteristics of your goods and services, or contain common and generic terms which are used in your trade and industry.
We will advise you on whether your trade mark is actually registrable and recommend a protection strategy which will guarantee that the application is accepted by the examiner at the EUIPO Office.

For EU applications, we will report all stages of the application process to you, which include filing the application, examination reports that require your instructions, publication of the application and the opposition period, the priority period, registration and renewal deadlines.
If there are any challenges made by third parties, we will also bring these to your attention.
We will monitor your trade mark in the EU using the latest trade mark watching AI technology. This means that we will notify you if there are any identical or similar marks filed by others that might conflict with your trade mark anywhere in the EU.
